1. Acceptance of Terms

By accessing or using AI Creative Lab ("the platform", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, do not use the platform.

2. Service Description

AI Creative Lab is an AI-powered video analysis platform that provides insights, Creative Scores, and recommendations to help content creators improve their videos. The service uses Google Vertex AI (Gemini) technology to perform automated analysis.

3. Registration and Account

To use the platform, you must:

  • Be at least 18 years old or have parental authorization.
  • Provide accurate and complete information during registration.
  • Keep your account credentials secure and confidential.
  • Notify us immediately of any unauthorized use.
  • Be responsible for all activity that occurs under your account.

4. Acceptable Use

You agree NOT to:

  • Use the platform for illegal or unauthorized purposes.
  • Upload content that infringes copyright or third-party rights.
  • Transmit malware, viruses, or malicious code.
  • Attempt to access other users' accounts or platform systems without authorization.
  • Use bots, scrapers, or other means to automate use beyond the limits of the public API.
  • Post content that is offensive, discriminatory, or that violates applicable law.

5. User Content

You retain all rights to the videos and content you upload to the platform. By uploading content, you grant us a limited license to process, analyze, and store it to provide the services. We do not claim ownership of your content and we do not share it publicly without your consent.

6. Third-Party Integrations

The platform integrates with third-party services (Instagram, TikTok, YouTube). Use of these integrations is subject to each provider's terms. We are not responsible for changes or interruptions in these external services.

7. Intellectual Property

All intellectual property rights in the platform, including software, design, logos, and trademarks, belong to AI Creative Lab or its licensors. You may not reproduce, modify, or distribute any part of the platform without our prior written authorization.

8. Limitation of Liability

To the maximum extent permitted by law, AI Creative Lab shall not be liable for indirect, incidental, special, or consequential damages resulting from your use of or inability to use the platform. Our total liability shall not exceed the amount paid by you in the last 12 months.

9. Warranty Disclaimer

The platform is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that the results of AI analyses will be 100% accurate. The Creative Score and recommendations are tools to support creative decisions, not absolute guarantees of performance.

10. Indemnification

You agree to indemnify and hold AI Creative Lab harmless against any claims, damages, or expenses arising from your use of the platform, violation of these terms, or infringement of third-party rights.

11. Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these terms or engage in activity that harms the platform or other users. You may cancel your account at any time through the settings.

12. Changes to the Terms

We reserve the right to modify these terms at any time. Significant changes will be communicated via email or a prominent notice on the platform. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of the District of São Paulo, SP.

14. General Provisions

If any provision of these terms is held to be invalid, the remaining provisions shall remain in effect. Our failure to enforce any right does not constitute a waiver. These terms constitute the entire agreement between you and AI Creative Lab regarding use of the platform.
